‘A proper licence is required if a user benefits directly or indirectly from any feature covered by that licence.‘ I’m not sure what an improper licence looks like :) Taken at face value it appears that any use requires all users to be licensed. One would have to prove a user did not ‘indirectly’ benefit to justify basic licensing only. I do think the P1 / P2 mix is a complicated question. I do think this is why EMS becomes attractive to larger orgs.

Yes it is confusing. The conclusion we have come to is P1 is not in the budget when considering the amount of users we have. It would be good to get direct and indirect status, verified by Microsoft.
My assumption is that I will have to disable features in the UI or use other techniques to managed Office 365 Group creation.
