I'm guessing whoever set up the custom formatting probably did so on a task by task basis such that the Gantt Bar for each of those tasks overrides the general setting under Bar Styles. Try this. Double click the Gantt Bar of one of those tasks and in the Format Bar window hit the "Reset" button. Repeat this for each of the tasks with the odd behavior.

Then I think Dale hit the nail on the head, those tasks are in fact, not on the critical path.
