After you add the doc set based content type to a library it takes a while for library settings to be fully updated, and for the content types included in the document set to be available via the New button. Until then you see the default New menu content types. It took about 40 minutes for this to update.

    No, Linc, not in this case. This was a quick test in a stand alone site collection. Good observation!
