Object Selection on Charts

I am having issues with object selection when the objects I am trying to select are sitting on top of a chart object; I posted my problem to the Excel Uservoice page here:

But I have also been advised to raise the issue on this board. The problem is that when trying to select multiple objects that are sitting on top of a chart object using the 'Object Selection' tool then as soon as I depress the mouse button to start to drag a selection area across the Shape objects I wish to select it simply selects the chart object precluding from being able to select the Shape objects

I have also noticed that the selection pane does not list objects that are sitting on top of a chart object

To me this appears to be broken rather than user error but if I am not doing something correctly then please enlighten me. Selection of multiple objects sitting on top of Charts using the object selection tool used to work fine in Excel 2010
