Windows 10 Pro / Pro Education devices not upgrading to Windows 10 Education

Hi,

I have a school who use Intune and the all the students and staff have M365 A3 licences via CSP. I have no problems with the devices enrolling, however some are upgrading to Windows 10 Education as i would expect when a user logs in, others however are not, they are staying with Windows 10 Pro or Pro Education. I spoke to Intune support who didnt seem to understand the difference. I looked on line and apparently Win10Pro/Pro Education should auto upgrade when the user signs in if they have a valid M365 A3 licence which they all do. 

I am now stumped on what or where to go.
