Thanks to all for their input thus far.
I have had a discussion with MS support and the answer is, yes, confidential data, not included in a user's prompt, may be sent as part of a web query.
- The data will be relevant to the user's prompt.
- Will include only data the user has access to.
- Will not include entire documents.
- Is disaccociated from the user and organisation, so lacks any context.
- Is encrypted in transit.
- Remains within the MS ecosystem.
