Hi JoS_2023, yes. This is 100% allowed and expected within organizations. It may be necessary to review what is in M365 E5 that could benefit those users and consider purchasing an add-on, as available/necessary.
This might depend on the details of your agreement with Microsoft, but as far as I am aware, there is nothing preventing any organization from purchasing and using E3 plans alongside E5 plans in the same tenant.
