Microsoft simply doesn't enforce licensing requirements in code for many of the features available in O365. It's your responsibility to make sure you are in agreement with the licensing terms.
VasilMichev You are absolutely right but as a service provider it is their responsibility to not confuse their customers. As an organization with many admins , it's really difficult to fight against others on an existing option.
