Bing Chat Enterprise AI infrastructure hosted outside EU or US.

Hej,

When using Bing Chat Enterprise you state that Bing Chat Enterprise is using Microsofts global

datacenters, this can theoretically mean that a chat prompt will be saved (for a short time) in a datacenter in India. This will be classified as a third-party transfer (according to EU rules) and can be a problem for european countries to use this feature with company data. 

 

Is there any solution to the problem above or have I misunderstood how Bing Chat Enterprise works?

      I am not entire sure but the new announced Enterprise data protection in Microsoft 365 Copilot and Microsoft Copilot might solve this matter.

    Because global data centers do the processing, that means that processing can happen around the world, including in the United States. Optional, Bing-backed connected services do not fall under Microsoft's EUDB commitment.

    If you're looking for a solution that can fall within tenant or geographic boundaries, we recommend Copilot for Microsoft 365.

      Is this still the case for Microsoft Copilot (formerly Bing Chat Enterprise)? It is not compliant in the EU, due to data may be processed in global and US data centers?

      Then we know that we cannot use Bing Chat Enterprise (Copilot) and add  internal content into the prompt. The EU rules dont have any issues with services hosted in US with the new Data Privacy Framework. But If hosted in India or other regions outside EU it can be problem.

    I would also be interested in understanding how this works.

     

    Edit: According to the Privacy & Protections page (specifically this section https://learn.microsoft.com/en-us/bing-chat-enterprise/privacy-and-protections#microsoft-as-the-data-controller), data "Bing Chat Enterprise uses global data centers for processing and may process data in the United States". This sounds like it's more likely than not that the data would be processed outside of the US.

     

    Pernille-Eskebo Can you confirm whether or not this is the case? And will Microsoft be adding any controls to force data residency for BCE in the future?
