Impact of adding E5 licenses

Thank you, but am I correct that, in fact, we only need 1 E5 license to enable the capability but are not compliant with the license agreement?

MicrosoftRVC generally I would say that is correct. If you have a premier agreement I would recommend connecting with your account manager though so a licensing specialist can provide input since that is less of a technical question. It can vary quite a bit across services.
