I used the EWS approach to apply a personal archive tag to the notes folder which prevented the archive DPT from taking action on this folder. The added bonus is that since this personal tag isn't apart of the retention policy a user is in they can't remove the personal tag from the Notes folder, nor can they apply it to another folder.
I had to do this because Exchange 2010 does not give us the ability to prevent archive DPT from applying to the notes folder.
