Does Microsoft offer legal protection for customers who use open source models hosted on Azure against AI-Generated copyright claims? My company would like to use these apis but would not like to put ourselves at legal risk.
CodeLlama Instruct, for example, was fine-tuned on a proprietary dataset. That's legally safe. CodeLlama itself was pre-trained on https://scontent-lga3-2.xx.fbcdn.net/v/t39.2365-6/369856151_1754812304950972_1159666448927483931_n.pdf?_nc_cat=107&ccb=1-7&_nc_sid=3c67a6&_nc_ohc=wnhjKkNZjfwAX9SAQzp&_nc_ht=scontent-lga3-2.xx&oh=00_AfBEOVVA9FR2B-yUM4tZc-bG9vF1ChhWH2bAkKAEzi8Z6g&oe=65C6398F#page=25&zoom=100,62,321. If that corpus includes code that was not permissively licensed, my company could be sued.
I know that Microsoft has an indemnity clause for CoPilot users but I can't find anything about an indemnity clause for these models.
