Message Encryption, Password Protected documents, and eDiscovery

Copper Contributor

I have a customer with questions about eDiscovery that I just don't have the answers to.  Hoping someone here can help.

If an email is encrypted with Office 365 Message Encryption, will eDiscovery be able to search that encrypted email?

If an email has an attachment that is password protected (like a password protected excel workbook), will eDiscovery put that email in the "unsearchable" results?

My thoughts on the password protected attachment is "it depends".  If the body of the email matches the search criteria of the eDiscovery, then the email should be in the actual results.  If the body of the email does not match criteria and the attachment is unsearchable, then the email should go to the items that are corrupt or not searchable results.

Any help would be appreciated.
