Hello
After upgrading an NCE subscription using the upgrade tool in the partner portal, apparently something did not go quite right, and I believe some manual work was involved.
There are still a few users assigned to the older subscription, and it still appears to be available to assign to users. How long does this state last before the subscription is deleted?
(I think they added a few new users to the upgraded product, so they ended up having the same number of licenses as the older version with all licenses assigned to users, and a few existing users are still assigned to and using the older version.)

I was out of the office last week and others were providing back up.
Since our Licensing Concierge team does not provide tech support, my response would have been that as a Partner, you should carefully log into Partner Center and utilize resources such as the following MS Learn Doc - Migrate subscriptions to new commerce - Partner Center | Microsoft Learn
as well as the NCE Handbook .
If you're unable to resolve your issue via the information above, you should submit a support ticket.

Ah, understood. Other partners may provide their experience with this type of upgrade. To get an official answer to "There are still a few users assigned to the older subscription, and it still appears to be available to assign to users. How long does this state last before the subscription is deleted?", you will need to go ahead and submit a support ticket.
