We have a customer where one of our techs made an error and applied a Microsoft 365 E3 license to their tenant earlier in the year via NCE CSP, and rectified the mistake within 24 hours so the license was not billed nor used by the customer.
However because the Microsoft 365 E3 DMWL 2023 Promo excludes any customer that "previously had Microsoft 365 E3 on their tenant", the customer is now ineligible for the promo. We explained the situation to partner support and the response is basically tough luck.
Really disappointing lack of flexibility and support in favour of the partner/customer under NCE yet again.

I'm sorry that this happened.
I understand that you explained the situation to partner support. However, have you reached out to your local ROC to ask for an exception since the ROC confirms customer eligibility?

@LicensingConcierge1 The team on that email address replied that they only deal with Dynamics licensing whereas this is Microsoft 365?
